NL: Council of State rules that the situation in Afghanistan is worrying, but not so bad that every Afghan must be given asylum

The Division finds that the general safety situation in Afghanistan, particularly in Nangarhar and Ghazni, remains unabatedly alarming. In certain respects, the safety situation in Afghanistan has even worsened compared to June 2018, the end point of the reporting period dealt with in the earlier ruling of the Division of 1 October 2018. On the other hand, however, the safety situation is not as serious in all provinces of Afghanistan and the violence is not of the same nature everywhere and is not just as widespread everywhere. The number of civilian casualties and displaced persons as a result of the violent actions in Afghanistan – no matter how alarming it may be – is not so high that a 15c situation exists for that reason alone, partly in view of the total number of residents in Afghanistan. In many places in Afghanistan a basic security structure is still present. In view of all this, the Division cannot conclude from the documents that a civilian, by his or her presence in Afghanistan alone, runs a real risk of serious injury as referred to in Section 29(1), preamble and under b, Part 3, of the Aliens Act (Vw). Therefore a 15c situation does not exist anywhere in Afghanistan.
