This case refers to the transfer of an asylum applicant with a new-born child to Spain under Dublin Regulation. In absence of information for adequate reception conditions and individual guarantees for their transfer back, the authorities didn't review closely the evidence regarding a real risk of treatment prohibited by Article 3 of the ECHR
