M.N.S. (Afghanistan) v Federal Administrative Court (Bundesverwaltungsgericht - BVwG)

AT: Supreme Court rules on submission of an application for a Dublin returnee

The Austrian Supreme Administrative Court held that the application for international protection lodged in another Member State by a Dublin returnee who already received a final negative decision in Austria (take back case in accordance with Article 18 (1)d)) is “automatically” taken over by the Austrian authorities and needs to be processed upon arrival in Austria. The applicant does not need to explicitly make an application again.

Access to procedures; Afghanistan; Dublin procedure;

Dublin Regulation III (Regulation (EU) No 604/2013 of the European Parliament and of the Council of 26 June 2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for IP); National law only (in case there is no reference to EU law/ECHR);
