A.Y.V. vs Belgium State represented by the State Secretary of Asylum and Migration (Staatssecretaris voor Asiel en Migratie en Administratieve Vereenvoudiging)

The CALL ruled that an implicit decision by the Immigration Office in the context of the Dublin III Regulation to extend the transfer period from 6 months to 18 months is a disputable administrative legal act. Such a decision must be motivated and be written so that effective judicial review is possible. The Immigration Office lodged an appeal with the Council of State to contest this interpretation of the CALL.
