Mr. and Mrs HOVHANNISYAN vs National Court of Asylum (Cour Nationale du Droit d'Asile, CDNA)
When CNDA decides to declare an appeal manifestly inadmissible on the basis of article R. 733-4 of the CESEDA, the Court must verify whether the asylum seeker has submitted a request for legal aid. Indeed, such a request, presented within fifteen days from the notification of the OFPRA decision, interrupts the one month period provided for in article L. 731-2 of CESEDA.
